## Purpose

A regulation changed. The user has internal policies. This workflow finds which policies the change touches and what the gap is between "what the regulation now requires" and "what the policy says."

## Inputs you'll ask for

1. The user's **Regulatory Practice Profile** (or provisional mode - see below).
2. The regulatory change - full text or a pasted excerpt broad enough to extract requirements honestly.
3. The internal policy text. The user should paste the policies that might be affected. If they have a policy library index (policy names, owners), paste that too so you can name owners and flag policies you have not seen.
4. Optional: a prior regulatory update review or gap memo on the same topic.

## If the profile is missing

Offer this once:

> Two choices:

> 1. Run **Regulatory Practice Setup** and paste the resulting profile here, or
> 2. Say **"provisional"** and I will diff against generic defaults - I will still need the actual regulation text and the actual policy text - and tag the output `[PROVISIONAL]`.

> Provisional mode can surface obvious gaps, but without your policy library index it cannot name owners or tell you which policies it has not seen.

If the user picks provisional:
- Tag the whole diff `[PROVISIONAL]`.
- Leave Owner cells `[unassigned]`.
- Never deliver a firm "fully compliant" conclusion without attorney review.

## Scope integrity

If the user asks you to exclude a policy section, requirement, or category from the diff:

1. Do it - the user owns the scope.
2. Flag it, loudly and permanently, above the header and carried into every downstream artifact:

3. Note what the exclusion means: "Excluding vendor management means the diff will show 'no policy addresses vendor management' - which is worse than showing the gap."

A compliance artifact built on an undisclosed scope exclusion looks like concealment in discovery. The flag is the difference between "we scoped the review" and "we hid the problem."

## Workflow order

### Step 0: Verify rule status before you diff

Before diffing a rule against policy, confirm the rule is plausibly in force. Red flags:

- The applicability / compliance date has passed by more than 30 days with no confirmation it was not delayed.
- The rule is more than 12 months old.
- The rule is a politically contentious final rule (major rulemakings are frequently challenged).

You cannot check a docket here. When you see a red flag, emit this banner above the header, before any content:

Tag every due date `[due date per published rule - status unverified]`. If a gap from this diff is later carried into the Compliance Gap Tracker, note `status_verified: false` so it is never routed to an Overdue bucket on a published date alone.

### Step 1: Extract the new requirements

**No silent supplement.** If the regulatory change text is partial or ambiguous and you do not have the fuller rule, stop and ask. Do not fill the gap from model knowledge. Say: "I have [what you pasted]. To extract requirements accurately I would need [what is missing]. Options: (1) paste the full text, (2) paste the section covering [X], or (3) proceed on what I have and I will mark the analysis incomplete. Which would you like?" The user decides whether to accept a partial diff.

**Source attribution.** Tag every citation - the regulatory citation, cross-references, policy excerpts - with where it came from: `[user provided]` for pasted regulation and policy text; `[model knowledge - verify]` for anything recalled from training. Items tagged `verify` carry higher fabrication risk and should be checked first. Never strip or collapse the tags.

Read the regulatory change. List each discrete new or changed requirement:

### Step 2: Map to policies

For each requirement, which pasted policy is closest?

- **Direct hit:** policy explicitly covers this topic.
- **Indirect:** policy covers a related topic; this is a new sub-issue.
- **No match:** no pasted policy addresses this - the gap is "policy does not exist (or was not provided)."

If the user gave a policy library index but not the full text of a policy that looks relevant, say so: "Requirement [N] likely touches [policy name from your index], but you have not pasted its text - paste it for a real diff."

### Step 3: Diff

For each direct or indirect hit, compare the policy text against the requirement.

### Step 4: No-match gaps

Requirements with no policy match get called out separately - either a new policy is needed, or the relevant policy was simply not pasted.

## Branches by regulatory input type

### Pre-rule branch (ANPR / RFI)

If the regulatory input is an ANPR or RFI (no imposed requirements), do NOT run a full gap-closure diff. Produce a **pre-positioning analysis** instead:

- Name the policies that will likely need to change once a final rule issues (not today).
- Flag whether any of the notice's issue areas intersect the company's practice in a way that warrants a comment letter.
- Note the comment deadline and route the comment decision to **NPRM Comment Tracker**.
- Do NOT produce per-requirement "no gap" rows - there are no requirements to diff. Produce one paragraph naming the future exposure and the policies it would touch.

### Negative-finding branch (final rule / NPRM diffed against a policy that is not the right target)

If every requirement comes out "no gap against [the named policy]," do NOT produce the full per-requirement analysis. Compress to a single short paragraph: the regulation does not appear to require a change to that policy, the policy already covers the topic, and the policies the regulation actually touches are [others] - rerun the diff against those. One paragraph, one recommendation, a routing note.

- Break composite provisions into discrete obligations - prefer one requirement per row.
- If the regulatory text could be read two ways, say so and name the conservative read rather than collapsing the ambiguity.

## What this workflow does not do

- It does not draft the policy updates - that is **Policy Redraft** or a human.
- It does not interpret ambiguous regulatory text definitively - if a rule could be read two ways, it flags for counsel.
- It does not monitor for future regulatory changes.
- It does not make the final risk-acceptance decision.
