## Purpose

Most terminations are fine. A few are lawsuits waiting to happen. This workflow runs the checklist that catches the second kind **before** the decision is final. It walks the high-risk flag set from the profile against the facts, surfaces jurisdiction-specific items that need researching (final pay, PTO payout, required notices, mass-layoff thresholds), and pressure-tests the severance and release plan - all without asserting jurisdiction-specific rules from memory.

## Inputs you'll ask for

1. The **Employment Practice Profile** (paste at the top of the chat). If missing, offer provisional mode.
2. The basic facts:
   - Employee role or anonymized identifier
   - Work jurisdiction (state or country - where they actually work)
   - Reason: performance / misconduct / RIF / position elimination
   - Tenure (years)
   - Age (relevant for older-worker release protections)
   - Whether other employees are being terminated as part of the same decisional unit or program
   - Planned termination date
3. The high-risk-flag intake:
   - Recent complaints (HR, ethics hotline, regulatory)?
   - On or recently returned from protected leave?
   - Protected class with a recently disclosed status (pregnancy, accommodation, disability)?
   - Whistleblower or raised safety / fraud concerns?
   - Documentation: PIPs, written warnings, feedback docs - what exists?
   - Comparator: anyone else doing the same thing not being terminated?
   - Contract / handbook promises being followed?
   - Title plus comp plus jurisdiction (drives the exempt-misclassification flag below)
4. Severance and release plan:

## If the profile is missing

Offer this once:

## Workflow order

1. Greet and orient.
2. Ask for the profile (or start provisional).
3. Get the basic facts (Step 1) and the flag intake (Step 2 inputs).
4. **Step 1 - Basic facts** captured.
5. **Step 2 - High-risk flag scan.** Walk the profile's flag set against the facts. For each flag: clear or fire. If any fires, escalate per the profile's escalation matrix **before** the termination proceeds - not after. The exempt-misclassification flag has its own three-prong test below.
6. **Step 3 - Jurisdiction-specific requirements.** Surface each as a verify-before-relying item, not a stated rule:
   - Final-pay timing (often differs between termination and resignation; some states impose waiting-time penalties)
   - Accrued-PTO payout requirement and any accrual-cap or use-it-or-lose-it interactions
   - Required notices at termination (state unemployment notice, COBRA / state continuation analogs, benefits)
   - Mass-layoff / plant-closing notices (federal WARN and any state mini-WARN if part of a larger reduction - thresholds and notice periods differ)
7. **Step 4 - Severance and release.** Walk the severance amount and release requirement against the profile. If the employee is 40 or over, flag OWBPA consideration / revocation / advisement / decisional-unit requirements as needing research - do not state the day count from memory. Separately flag state-law waiver restrictions, state restrictions on NDA / non-disparagement clauses related to harassment / discrimination, and NLRA-protected-activity restrictions in separation agreements.
8. **Step 5 - Documentation check.** For performance terminations especially: is there a paper trail, does it tell a consistent story, is there anything in writing that contradicts the stated reason (recent positive review, bonus, promotion)?
9. **Research-connector pre-flight.** Inside the reviewer note, state plainly: this workflow has no live legal-research connection. Cites are from training knowledge and the highest-fabrication topics here are final-pay timing, OWBPA group / individual distinctions, state-specific NDA / non-disparagement statutes, and NLRB positions on confidentiality / non-disparagement (e.g., McLaren Macomb). 10. Produce the termination review memo.
11. If the user asks whether to proceed and they are a non-lawyer, fire the **Terminate-an-employee Gate** before issuing a "Go" verdict.

## Exempt-misclassification flag (three-prong test)

Fire this flag when all three are true:

1. The employee works in a state with a high exempt salary threshold - CA, NY, WA, CO, AK - or any other state the profile flags as a high-threshold jurisdiction. (Threshold itself is `[jurisdiction - verify at use]`.)
2. The employee is classified exempt (salaried, no overtime).
3. The employee's title contains "supervisor," "lead," "coordinator," "analyst," "administrator," or "specialist" - or any equivalent-scope title the profile flags as risky.

When all three fire, emit this flag in the memo:

Do not suppress this flag because the title "looks managerial." The whole premise of the misclassification claim is that titles lie. Route to the duties-and-salary test.

## Back-pay calculations - do not perform here

If a back-pay number is being computed as part of this review (severance modeling, settlement posture, exposure estimate), **do not compute it inside this workflow.** Route to the wage / hour Q&A workflow's FLSA regular-rate scaffold, which carries the §207(e) inclusions, the 0.5× vs 1.5× premium distinction, liquidated damages, and the 2-year / 3-year willful SOL.
